If the dispute cannot be resolved informally, you agree that any dispute arising out of or relating to these Terms or the Service will be resolved through binding arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association. The arbitration will take place in Delaware, and judgment on the arbitration award may be entered in any court having jurisdiction.

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You and we agree that each may bring claims against the other only in your or its individual capacity.
